2. Purpose of the Website

The website genealogic.io provides access to the Genealogic platform, a digital service for owners and breeders of purebred dogs to record, consult and manage canine genealogies, together with related professional tools.

3. Terms of Use

Use of the website is governed by the Terms and Conditions and the Privacy Policy, which the user declares to know and accept by accessing the website.

4. Intellectual and Industrial Property

All content on the website — including, by way of example, editorial texts, source code, graphic design, interfaces, corporate photographs, videos, logos, trademarks, trade names, databases and software — is owned by Manuel Curtó SL or by its respective owners, and is protected by Spanish intellectual and industrial property law and by the applicable international conventions.

Any form of reproduction, distribution, public communication, making available, transformation or use, by any means or in any medium, is prohibited without the prior express authorization of Manuel Curtó SL, except as permitted by law or by the specific terms of the Service. Access to the website does not grant the user any right or title over such content.

The genealogical database is protected by the sui generis database right (arts. 133–137 of the Spanish Intellectual Property Act, LPI; Directive 96/9/EC). The extraction or re-utilization of substantial parts of the database — assessed qualitatively or quantitatively — without express authorization is prohibited, as is the repeated or systematic extraction of insubstantial parts that conflicts with the normal exploitation of the database.

5. Liability

Manuel Curtó SL states that:

It is not responsible for the truthfulness, accuracy or completeness of the data entered by Users on the Platform, nor for the decisions that third parties make based on that data.
It is not responsible for damages arising from the misuse of the Platform by Users or by third parties.
It is not responsible for service interruptions due to technical causes, scheduled maintenance, cyberattacks or force majeure, without prejudice to its reasonable efforts to maintain availability.
It is not responsible for the content of third-party websites linked from Genealogic; links are provided for information purposes only.
It does not take part in commercial transactions between Users. Any sale, provision of services or agreement between Users is governed by their own terms.

6. Hosting Service Provider Regime

Manuel Curtó SL acts as an intermediary service provider in the form of data hosting, pursuant to arts. 13 to 17 LSSI-CE. The company does not exercise prior editorial control over the content provided by Users and will remove unlawful content once it has actual knowledge of its unlawfulness, in accordance with the procedure set out in the Intellectual Property and Notice-and-Action Policy.

7. Data Protection

The processing of personal data is governed by the Genealogic Privacy Policy, drawn up in accordance with the GDPR and the Spanish Organic Law 3/2018 on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD).

9. Governing Law and Jurisdiction

This legal notice is governed by Spanish law. For the resolution of any dispute arising from access to or use of the website, the parties submit to the Courts and Tribunals of Santa Cruz de Tenerife, without prejudice to the mandatory rights of consumers under the Spanish General Law for the Defence of Consumers and Users (TRLGDCU).
